Prices quoted are applicable
for 30 days from the date of the proposal.
Prices are in US Dollars. The rate of conversion
prevalent on the date of Purchase Order will
be applicable for payment. |

Full payment will be made in advance along
with the Purchase Order, unless otherwise
agreed to by SYBOR, by Cheque drawn in the
name of Sybor Solutions Pvt. Ltd. and payable
at PAR in Bangalore
|
|
|
Taxes applicable will be charged extra.
|
|
|
Purchase Orders should be placed by client
which should include description, quantity,
shipping dates, destination and delivery schedules
etc. and clearly agreeing to the Purchase
Order being subject to the "Terms and
Conditions of supply of netIQ products"
|
|
|
All though the customer may use their standard
purchase order formats and or any other format
/ forms, the terms and conditions stipulated
in this proposal will prevail over conditions
and or stipulation if any in customers' forms
and any conflicting or additional terms in
such forms would not be binding on Sybor.

|
|
All or a portion of purchase order may
be cancelled if such cancellation is received
by SYBOR 14 (fourteen) days prior to the scheduled
shipment date.
|
|
|
Delivery shall be scheduled by netIQ as
per the requested delivery plan. SYBOR shall
not be liable for failure to meet such delivery
by netIQ for any reason whatsoever.
|
|
|
Unless otherwise specified by or agreed
by SYBOR / netIQ in writing delivery shall
be made by either of them. The delivery could
be by electronic transfer as well. Mode of
delivery should thereafter be clearly specified
in the customer Purchase Order.

|
|
The end user license will be provided by
netIQ to the customer.
|
|
|
Warranty of the product will be provided
by netIQ as per the terms of Maintenance Agreement
separately signed between the customer and
netIQ. No claim shall lie on Sybor for any
defects malfunctioning. However, Sybor would
offer their good offices to resolve issues
between the customer and NetIQ, should the
customer request Sybor to do so.

Implementation and Knowledge Transfer can
be provided by Sybor on separate service agreement.
The service agreement if any does not form
part of these terms.

|
Indenters placing orders on Sybor for the
supply of products or services are deemed
to have agreed to be governed by these terms
and conditions.
